Look for a consequential uncertainty
Independent review is most useful where a technical inference matters to the case and its basis is unclear, incomplete or disputed. The volume of digital material alone does not determine the need. A small set of records can carry a major assertion; a large extraction can be largely irrelevant to the question.
Ask what would change if the inference were narrower than currently stated. That helps prioritise the technical issue and keeps the work proportionate.
Common reasons to seek a preliminary opinion
A timestamp is being treated as proof of a deliberate act. A device is associated with a person but the mechanism of attribution is unexplained. A report presents selected records without enough context to test them. Two reports disagree about the same item. An acquisition excludes a source that may be necessary to evaluate an alternative explanation.
These are prompts for inquiry, not conclusions that the evidence is unreliable. Some issues can be resolved by clarification from the original examiner. Others require examination of the underlying material or a controlled test.
Match the first step to the decision
A preliminary review can answer whether the question is within scope, which records are needed and whether further work is likely to be informative. A conference may be sufficient to explain a technical distinction. A report may be required where an opinion is to be relied upon.
Define the deadline and intended use at the outset. A request to “review everything” is less useful than a question such as: “Does this record distinguish deliberate opening from an automatic process, and what would be needed to test that?”
What review cannot promise
An independent expert may confirm the original finding, narrow it, identify a different interpretation or conclude that the available material cannot resolve the question. Independence means that all of those outcomes remain possible.
Discuss a preliminary review through the instructing legal practitioner. Do not send substantive case material until conflict checking and engagement arrangements are complete.
